Registration with the Catalan Register of Estate Agents (AICAT) is compulsory in order to work as an estate agent in Catalonia, and the number must be available for consultation. It is governed by Decret 12/2010.

What you can do on this website

This website provides information about Top House Real Estate's services and lets you request a valuation or get in touch. Using it is free and requires no registration.

By using it, you undertake not to use it for any unlawful purpose, not to attempt to damage it and not to access any parts that are not public.

The valuation calculator

The estimate returned by the calculator is indicative and automatic. It is calculated from average market prices by town and some general coefficients, and it replaces neither a formal appraisal nor a visit. Two homes with the same floor area on the same street can be worth very different amounts.

No result from this calculator constitutes an offer, a commitment to buy, or an official valuation for mortgage, tax or judicial purposes. That requires a certified appraisal.

The properties listed

The prices, floor areas, photographs and features shown on the buy and rent pages are indicative and may change without notice. The definitive information for each property is provided in writing before any reservation or contract.

Who owns the content

The text, design, images, video, logo and code of this website belong to Top House Real Estate or are used with permission. Reproducing or reusing them without written authorisation is not permitted.

Liability

Care is taken to ensure that everything published is correct and up to date, but no guarantee is given that there are no errors or that the website will be available without interruption. Nor is any responsibility accepted for the content of other websites linked from here.

Governing law

These terms are governed by Spanish law. For any dispute, and unless the law imposes another jurisdiction (as it does for consumers, who may go to the courts where they live), the parties submit to the courts of Arenys de Mar.

Who processes your data

What data we collect, and only when you write to us

This website does not ask you for any data in order to view it. There is no registration, no account and no tracking. There are only two moments when you give us information, and in both because you choose to:

• The valuation calculator. The property details (type, town, area, floor area, condition, rooms) are calculated inside your own browser and are not sent anywhere. If you do not carry on, they never leave your device.
• The contact form. Here it does: your name, your telephone number, the area of the property, what you need and the message you write.

How it reaches us: by WhatsApp

This matters and you should know it before pressing the button. This form does not send anything to a server of ours: it opens WhatsApp on your phone or computer with the message already written, and you decide whether to send it.

That means your data travels through WhatsApp, which is a service of Meta Platforms Ireland Limited, and is subject to their terms and privacy policy, including any international data transfers Meta may make. We do not control that processing.

If you would rather not use WhatsApp, you have two alternatives that do not involve Meta: call us on 605 27 31 50 or come to the office.

What we use your data for

• To get in touch with you and answer what you ask us.
• To prepare and carry out the valuation of your home, if that is what you requested.
• To manage the relationship if you go on to instruct us for the sale or the letting.

We do not use your data for advertising, we do not send you newsletters you have not asked for and we do not share or sell your data to third parties.

Our legal basis for processing

• Your consent, given when you send us the message, so we can contact you and deal with your request.
• Performance of a contract or steps taken before entering into one, if you instruct us for a service.
• Legal obligations, such as tax obligations and anti-money-laundering rules, which in the property sector require the parties to be identified and documentation to be kept.

Who else sees it

Besides WhatsApp, as explained above, your data may be accessed by the providers that serve us and are contractually bound to the same confidentiality: our property CRM, our accountants and our web hosting provider. Also public authorities where the law requires it.

This website is hosted by Hostinger, on servers in the European Union.

How long we keep it

For as long as the relationship lasts, and afterwards for as long as legal obligations require (for example, six years for commercial records and ten for anti-money-laundering records). If your enquiry comes to nothing, we delete your data once it is no longer needed.

What you can require of us

You may ask us at any time to access your data, rectify it, erase it, restrict or object to its processing, and request its portability. You may also withdraw your consent whenever you wish, without affecting processing carried out beforehand.

To exercise them, write to us at info@tophouserealestate.es or to our registered office, stating which right you wish to exercise and enclosing a copy of a document identifying you.

If you believe we have not dealt with you properly, you may complain to the Spanish Data Protection Agency, at www.aepd.es.

Menores

This website is not aimed at children under 14 and we do not knowingly collect their data.

Cookie policy

This website does not use cookies. Neither its own nor third-party ones. Nor does it store anything in your browser by other means.

That is why you will not see a cookie banner

The banner that pops up on almost every website exists because the law requires your permission before installing cookies that are not strictly necessary. Here there are none to install, so asking your permission would be asking for nothing. We would rather not bother you with a window that means nothing.

What we have deliberately avoided

• No analytics. There is no Google Analytics and no visit counter. We do not know who comes in, from where, or what they look at.
• No advertising pixels. There is no Meta pixel or anyone else's. Visiting this website does not mean our adverts will follow you around afterwards.
• No external fonts. The typefaces are served from this same domain. Linking them from Google would send your IP address to Google without asking you, which is exactly what has been penalised in Europe.
• No embedded maps or videos. The video on the home page is hosted here.

The result is that, while you browse this website, your browser does not talk to any server other than ours. You can check this yourself with your browser's developer tools, in the network tab.

If this were to change

If one day we add analytics, a chat widget or a map, this will no longer be true: the corresponding cookie banner will appear and this page will be updated first.
